By accessing our website, placing an order, requesting customization, submitting artwork, approving a design proof, or purchasing our products or services, you agree to these Terms & Conditions and the policies referenced herein.
If you do not agree with these Terms & Conditions, please do not use our services or place an order.
1. Use of Our Website
You may use the Punto Marca website only for lawful purposes.
You agree not to:
- Interfere with the operation or security of the website.
- Attempt unauthorized access to our systems or accounts.
- Introduce viruses, malicious code, or harmful software.
- Collect information about other users without authorization.
- Use our website for fraudulent or unlawful purposes.
- Misuse, reproduce, or exploit our content in violation of applicable law or intellectual-property rights.
Punto Marca reserves the right to restrict or terminate access when reasonably necessary to protect our business, customers, website, or services.
2. Products & Services
Punto Marca offers apparel, accessories, and other products that may be sold blank or customized.
Customization services may include:
- DTF printing.
- Screen printing.
- Embroidery.
- Other printing, decoration, or personalization methods offered by Punto Marca.
Product availability, brands, styles, materials, sizes, colors, specifications, and customization options may change.
We reserve the right to modify or discontinue products or services.
3. Product Images, Colors & Mockups
We make reasonable efforts to accurately display our products and customization options.
However, photographs, digital images, mockups, and design proofs are visual representations.
The physical product may vary slightly because of:
- Screen or device settings.
- Lighting.
- Garment materials.
- Manufacturing variations.
- Dye lots.
- Printing inks.
- DTF materials.
- Embroidery threads.
- Production processes.
Reasonable variations inherent to the manufacturing or customization process are not necessarily considered defects.
4. Customer Content & Artwork
Customers may provide logos, artwork, photographs, text, names, numbers, trademarks, or other materials for customization.
By providing content to Punto Marca, you represent that you either own the content or have the necessary permission or legal authority to use and reproduce it.
The customer is responsible for obtaining permission to use copyrighted works, trademarks, logos, photographs, or other protected materials.
Punto Marca reserves the right to reject a customization request when we reasonably believe that the requested content violates applicable law or another party’s intellectual-property rights.
5. Design Proofs & Customer Approval
For certain customized orders, Punto Marca may provide a digital proof or mockup before production.
The customer is responsible for carefully reviewing all order and design details, including:
- Spelling.
- Names.
- Dates.
- Numbers.
- Artwork or logo.
- Garment style.
- Color.
- Size.
- Quantity.
- Design dimensions.
- Design placement.
- Printing or embroidery method.
When the customer approves the proof, Punto Marca is authorized to manufacture the order according to the approved specifications.
Once the proof is approved and production begins, changes may no longer be possible.
Changes requested after approval may result in additional charges when they can still reasonably be made.
6. Artwork Quality & Design Services
The quality of a finished customized product depends partly on the quality of the artwork provided by the customer.
Customers should provide artwork that meets the specifications requested by Punto Marca.
Additional charges may apply if artwork requires services such as:
- Vectorization.
- Image cleanup.
- Recreation.
- Redesign.
- Print preparation.
- Embroidery digitizing.
Any applicable additional design or preparation charges should be communicated before the applicable paid work is performed.
7. Orders
Before placing an order, customers are responsible for reviewing:
- Products.
- Sizes.
- Colors.
- Quantities.
- Customization.
- Artwork.
- Shipping information.
- Billing information.
- Prices.
- Discounts.
- Taxes.
- Shipping charges.
- Final total.
An order confirmation indicates that we have received your order. It does not necessarily mean that production has begun.
Additional information, payment, artwork, or design approval may be required before production.
Punto Marca may reject or cancel an order for legitimate reasons, including:
- Product unavailability.
- Obvious pricing or listing errors.
- Suspected fraud.
- Payment problems.
- Inability to complete the requested customization.
- Intellectual-property or legal concerns.
If Punto Marca cancels a paid order before fulfillment, the applicable amount paid for the canceled portion will be refunded as appropriate.
8. Prices & Quotes
Prices are shown in U.S. dollars unless otherwise indicated.
Prices may change for future orders without prior notice.
Price changes will generally not affect an order already accepted and paid, except when an obvious pricing or technical error has occurred and correction is permitted by applicable law.
Custom quotes may have their own expiration dates, quantities, specifications, and conditions.
9. Payments
Payment may be required before production begins.
Available payment methods will be displayed at checkout or identified on the applicable quote or invoice.
Payments may be processed through third-party payment providers.
Customers are responsible for providing accurate payment and billing information.
Punto Marca does not require customers to send complete card numbers, CVV/security codes, or banking passwords through ordinary email, text messages, or social-media messages.
10. Sales Tax
Applicable sales tax will be calculated and collected when required by law.
Tax may depend on factors including:
- Product type.
- Transaction type.
- Delivery destination.
- Applicable state or local tax rules.
Customers claiming a tax exemption may be required to provide valid documentation before an exemption is applied.
11. Cancellations
Cancellation requests must be made before production begins.
Once production of a customized product begins, the customized portion of the order generally cannot be canceled.
Completed design, setup, digitizing, artwork preparation, or other separately disclosed services may be nonrefundable when applicable.

12. Custom & Personalized Products — Final Sale
Customized products are made specifically according to the customer’s specifications.
Therefore, customized, printed, embroidered, screen-printed, DTF-printed, or otherwise personalized products are generally FINAL SALE once production begins, except when otherwise required by law or provided under our Returns & Cancellations Policy.
Customer errors generally do not qualify a personalized product for return or refund, including errors involving:
- Size.
- Color.
- Spelling.
- Names.
- Dates.
- Numbers.
- Artwork.
- Design placement.
- Other specifications supplied or approved by the customer.
13. Damaged, Defective or Incorrect Orders
If Punto Marca makes an error, or an order arrives damaged, defective, incorrect, or materially different from the approved specifications due to an error by Punto Marca, please contact us according to our Returns & Cancellations Policy.
We may request photographs and other reasonable information necessary to evaluate the claim.
Depending on the circumstances and applicable law, an approved claim may result in:
- Correction.
- Replacement.
- Exchange.
- Refund.
14. Shipping & Delivery
Shipping methods, charges, and available options may be displayed at checkout or included in an applicable quote.
Production time and shipping time are separate.
Unless Punto Marca expressly provides a written guaranteed deadline, production and delivery dates are estimates.
Delivery may be affected by circumstances outside our reasonable control, including carrier delays, weather, transportation disruptions, holidays, and other events.
Customers are responsible for providing complete and accurate shipping information.

15. Production Times
Production may begin after all requirements necessary to manufacture the order have been satisfied.
Depending on the order, these requirements may include:
- Payment.
- Artwork submission.
- Design approval.
- Product availability.
- Confirmation of customization details.
Large, complex, or special orders may require additional production time.
16. Customer-Supplied Garments & Products
Punto Marca may, at its discretion, agree to decorate garments or other products supplied by a customer.
Printing, embroidery, and other production processes involve inherent production risks.
Before production begins, additional conditions may be established regarding customer-supplied merchandise, including spoilage, replacement, quantity, and responsibility for accidental production damage.
Any special conditions applicable to a customer-supplied product should be agreed upon before production.
17. Intellectual Property
The Punto Marca name, logo, branding, original website content, photographs, graphics, text, original designs, and other content owned by Punto Marca are protected by applicable intellectual-property laws.
Such content may not be reproduced, distributed, sold, or commercially exploited without authorization, except as permitted by law.
Customer-provided artwork remains the property of its lawful owner.
Producing a customer’s artwork does not transfer ownership of that artwork to Punto Marca.
18. Third-Party Services
Punto Marca may use third-party providers for services such as:
- Website and ecommerce technology.
- Payment processing.
- Shipping.
- Garment supply.
- Email communications.
- Analytics.
- Marketing.
- Security.
Third-party services may be governed by their own terms and privacy policies.
To the extent permitted by applicable law, Punto Marca is not responsible for independent third-party websites or services that we do not control.
19. Website Errors & Inaccuracies
Our website may occasionally contain:
- Typographical errors.
- Incorrect descriptions.
- Pricing errors.
- Incorrect availability information.
- Technical errors.
We reserve the right to correct errors and update information.
If an error materially affects an order already placed, Punto Marca will take reasonable steps to notify the customer and provide an appropriate resolution consistent with applicable law.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Punto Marca will not be liable for indirect, incidental, special, or consequential damages arising from the use of our website, products, or services.
Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited.
21. Force Majeure
Punto Marca will not be responsible for delays or failures caused by circumstances reasonably outside our control, including:
- Severe weather.
- Natural disasters.
- Power or Internet outages.
- Transportation disruptions.
- Carrier interruptions.
- Labor disruptions.
- Government actions.
- Supplier shortages.
- Other similar circumstances.
We will make reasonable efforts to communicate significant delays affecting an order.

Personal information collected through our website is handled according to our Privacy Policy.
Information processed by third-party payment providers or other independent providers may also be subject to their respective privacy and security practices.
23. Returns, Refunds & Exchanges
Returns, refunds, exchanges, damaged products, and other related claims are governed by our Returns & Cancellations Policy.
Customers should review that policy before placing an order, particularly when purchasing customized merchandise.
24. Changes to These Terms
Punto Marca may update these Terms & Conditions from time to time to reflect changes to our services, business practices, or applicable requirements.
The current version and its most recent update date will be published on our website.
Changes generally apply prospectively and do not retroactively alter completed transactions except where required or permitted by applicable law.
25. Governing Law
These Terms & Conditions are governed by applicable laws of the State of Connecticut and the United States, without limiting any mandatory consumer rights that may apply.
Nothing in these Terms is intended to waive a right or remedy that cannot legally be waived.
26. Severability
If any provision of these Terms & Conditions is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
27. Entire Agreement
These Terms & Conditions, together with:

- Our Privacy Policy.
- Our Shipping Policy.
- Our Returns & Cancellations Policy.
constitute the general terms governing purchases and use of Punto Marca’s website and services, unless Punto Marca and the customer enter into a separate written agreement.
